2. General Provisions
2.1. These Terms of Use (the “Terms”) govern the relationship between Limited Liability Partnership “Liberty Astana” (the “Company”) and the individual using the Smart Lift mobile application (the “User”).
2.2. By downloading, accessing, or using the Smart Lift application, the User acknowledges and agrees to be bound by these Terms and the Company’s Privacy Policy.
2.3. The Company reserves the right to modify these Terms at any time. Any updates will become effective upon publication within the application.
3. Purpose of the Application
3.1. The Smart Lift mobile application provides users with tools to manage their accounts within the Smart-Lift system (the “Smart-Lift Accounts”).
3.2. The creation, maintenance, and servicing of Smart-Lift Accounts are subject to a separate personalized Service Agreement concluded directly with the Company at its offices.
3.3. The application functions as a technical interface for account management and does not replace the contractual relationship established under the Service Agreement.
4. Personal Data and Processing Purposes
4.1. Categories of Data
Mobile phone number (for authentication and verification purposes);
Technical information (device model, OS version, IP address, push identifiers, error logs);
Usage data (login timestamps, in-app actions, customer support requests);
Anonymized analytical data (to improve stability, performance, and security).
4.2. Purposes of Processing
Registration and authentication of the User in the application;
Providing access to Smart-Lift account features and maintaining service security;
4.3. Legal Basis
Processing of personal data is carried out pursuant to the Law of the Republic of Kazakhstan “On Personal Data and Their Protection” dated May 21, 2013 (No. 94-V), and the User’s explicit consent or contractual necessity.
4.4. Data Retention
Personal data will be retained for as long as necessary to fulfill the purposes described herein or as required by applicable law. Upon expiration of such period, data will be securely deleted or anonymized.
4.5. Disclosure to Third Parties
The Company may share personal data with third-party service providers (such as hosting, communication, or payment processors) bound by confidentiality and data protection obligations. The Company does not sell or disclose personal data to third parties for marketing purposes without prior consent.
4.6. User Rights
Right to access, correct, and delete their personal data;
Right to withdraw consent to data processing, subject to possible functional limitations;
Right to receive information about any third parties granted access to their data.
To exercise data protection rights, please send a written request to info@smart-lift.kz or contact the Company’s office as provided in Section 1.
5. Deleting an App Account
Open the Smart Lift application;
Tap “Settings” in the upper-left corner;
Select “Delete Application Account”;
Confirm the deletion by tapping “YES”.
Deleting the application account will remove locally stored data from the device. Smart-Lift account data (contracts, access keys, balance) are managed under the separate Service Agreement and can be deleted upon written request submitted to the Company.
6. Application Features
Connecting one or more Smart-Lift Accounts. Authorization requests are verified by a confirmation code sent to the phone number linked to the account.
Managing physical access keys: adding, removing, blocking, and updating key status or tariff plans.
Support Chat: contacting Smart-Lift support for issues related to elevators, billing, or account access.
“Virtual Key” access: enabling contactless elevator operation where technically supported.
7. Rights and Obligations
7.1. User Obligations
Use the application in compliance with these Terms and applicable laws;
Refrain from actions that may disrupt service integrity or security;
Keep authentication codes and account credentials confidential.
7.2. User Rights
Access and use the application features in accordance with these Terms;
Request support or submit feedback through official channels;
Delete their application account at any time.
7.3. Company Rights
Update, modify, or suspend parts of the application for maintenance;
Process anonymized data for internal analysis and service optimization;
Restrict access to Users who violate these Terms or compromise system security.
8. Limitation of Liability
The Company shall not be liable for any malfunctions, data loss, or service disruptions caused by the User’s device, network, or third-party providers.
The User is solely responsible for maintaining the security of their device, SIM card, and access credentials.
The Company shall not be held responsible for any damages resulting from unauthorized access by third parties due to the User’s actions or negligence.
9. Governing Law and Dispute Resolution
9.1. These Terms shall be governed by and construed in accordance with the laws of the Republic of Kazakhstan.
9.2. Any disputes arising from or in connection with these Terms shall first be resolved amicably through negotiations. Failing such resolution, disputes shall be submitted to the competent court at the Company’s registered address.
10. Third-Party Advertising and Analytics (Google AdMob)
The Smart Lift mobile application integrates Google AdMob to display in-app advertisements. Google may automatically collect and process certain data through AdMob, including:
Device identifiers (Advertising ID / IDFA);
IP address and approximate location;
Device type, model, and operating system version;
App usage data, ad interactions, and ad frequency;
Diagnostic and performance information.
This information is used by Google for ad personalization, frequency capping, analytics, and fraud prevention. Users may refer to the following resources for more information:
Users located in the European Economic Area (EEA) and the United Kingdom are presented with a consent form in accordance with Google’s EU User Consent Policy, allowing them to choose whether to receive personalized or non-personalized ads.
This application is designed for adult users and minors aged 13 years and above. All advertisements displayed through the application are appropriate for audiences of this age category.
